Do The Scripts On Www.dynamicdrive.com Count As Open Source?

I want to use a dynamic JavaScript menu in my web site, but it explicitly has to be Open Source, “recognised by the Open Source Initiative”.
I’ve found the perfect script on www.dynamicdrive.com. The terms of use *look* Open Source but I don’t know if it’s officially recognised as ‘open source’ or just ‘free’..?
Any pointers (especially links) would be appreciated
